This page contains the complete terms of service, waivers, disclaimers, policies, and legal agreements governing all Moto.Red Design House LLC services and this website. All documents on this page are legally binding. By accessing this website, booking any service, making any payment, subscribing to any communication, or participating in any session, you acknowledge that you have read, understood, and agree to be bound by all terms published on this page.

Moto.Red strongly recommends reading each document in full before booking any service. If you have questions about any term or provision, please contact us before making a purchase. Your payment and participation constitute your electronic signature and binding acceptance of all applicable terms.

TERMS AND CONDITIONS
Terms and Conditions
General Terms
All services provided by Moto.Red Design House LLC (“Moto.Red,” “we,” “us,” or “our”) are provided as-is without warranty or guarantee. All payments and deposits are non-refundable. A 100% payment is required to move forward on project work unless otherwise specified in a written agreement.
Client and Designer agree to work together in good faith, be responsive to requests within 72 hours (three business days), and complete all project work within a reasonable timeline that adheres to a mutually agreed-upon schedule.
Moto.Red is not held responsible for project delays due to Client unresponsiveness or failure to deliver required project resources including but not limited to credentials, documents, content, feedback, and approvals.
Designer and Client may mutually agree to alter arrangements in writing as needed. Early termination by the Client results in the remaining balance becoming due immediately.
Moto.Red and its representatives provide the highest quality service based on over two decades of professional experience and strive to satisfy the requirements of each project and the reasonable requests of each Client.
Service Hours
Hours are estimated towards defined goals and are not exact. Project time requirements may exceed the estimated time. Additional hours beyond the agreed scope are billed at $250 per hour.
Any paid time on a project that is not used by project completion will be credited towards future work. All hours are non-refundable and expire 12 months from the payment date they were added to the Client’s account.
Resources
Moto.Red has an extensive library of resources acquired over the life of the business and provides Clients access to these as needed for projects. When possible, Moto.Red will include available licensing and resources for the Client at no additional cost.
If a project requires a resource that is not available in our collection, there may be an additional charge. The Client will be informed of costs and available options prior to any investment being made. Upon approval, the Client will be required to make an agreed-upon payment for resources prior to the resources being secured and the project moving forward.
Moto.Red is not responsible for providing free resources and only does so as a courtesy on a per-project basis. Resources can be revoked if the Client is found to be misusing, abusing, or refusing to honor an agreement around the resources, including failure to make agreed-upon payments.
Project Timeline
All goals, benchmarks, and timeline items are estimates and should be treated as such. Collaborative work is dependent on all parties contributing their part as agreed to move towards the completed work.
Moto.Red is committed to delivering all work to the best of its abilities and strives to meet all objectives when possible. However, we cannot guarantee with absolute certainty that all timelines will be met due to the nature of collaborative project work.
The Client understands that goals and deadlines are flexible, that all timelines are estimates, and that it is their sole responsibility to plan for potential deadline changes and associated event alterations. Moto.Red will not be held responsible for any lost earnings, media coverage, or other foreseeable or unforeseeable damages associated with timeline changes.
Feedback and Deadlines
Feedback is required within 3 business days of receiving deliverables at each checkpoint leading up to the deadline. If the 3-day window is missed, the project halts and the deadline may be changed to accommodate the delay.
Moto.Red is not responsible for delays caused by the Client missing feedback or resource request deadlines.
Addendums and Change Orders
At any time during the project, an addendum can be added to change the direction of the project. These addendums must be agreed to by all parties, and necessary compensation must be made in order to implement such change orders.
Documentation
As a project progresses, it is common practice to create documentation around resources used and how to work with them. Not all projects require documentation. All documentation is created with billable hours.
The Client may opt out of having documentation created, though it is recommended to allot billable hours towards documentation so that future users of the project can quickly educate themselves on complex systems, custom code, or multi-layered file formats. Documentation can be created in image, text, audio, and video formats.
Confidentiality and Intellectual Property Rights
All confidential business information provided by the Client during the course of a project is treated as confidential by Moto.Red. Confidential business information includes but is not limited to: financial data, proprietary business strategies, internal documents, client and customer lists, passwords, access credentials, personal health information, and personal identifying information.
Moto.Red will not disclose confidential business information to any third party without the Client’s written consent, except as required by law.
Upon full payment, the Client will own the intellectual property rights to the final deliverables created specifically for them, while Moto.Red retains rights to all pre-existing materials, methodologies, tools, frameworks, templates, and processes used in the creation of those deliverables.
Portfolio and Marketing Rights
Moto.Red retains the unrestricted right to display completed creative work in its portfolio, website, social media, award submissions, case studies, marketing materials, and promotional content. This includes but is not limited to visual design, website screenshots, brand identity elements, photography, and general descriptions of the project scope, process, and results.
Portfolio usage will never include the disclosure of confidential business information as defined in the Confidentiality section above. Moto.Red may reference the Client by name and industry unless the Client requests anonymization in writing.
If the Client wishes to restrict Moto.Red’s portfolio and marketing usage of the creative work itself, the Client must submit this request in writing before the project begins. Portfolio restriction requests are subject to a 20% increase on the total project investment to compensate for the loss of marketing value. Restriction requests made after the project has commenced will not be honored unless accompanied by a written amendment and corresponding compensation.
For clarity: this is not a non-disclosure agreement. Moto.Red does not sign NDAs as part of standard client engagements. The protections described in the Confidentiality section above provide substantive protection for the Client’s sensitive business information while preserving Moto.Red’s right to demonstrate its professional capabilities.
Mutual Non-Disparagement
Both the Client and Moto.Red agree to refrain from making false, misleading, or intentionally harmful statements about each other, whether publicly, privately, verbally, or in writing, including on social media, review platforms, professional networks, and in communications with third parties.
This clause does not restrict either party from providing truthful information as required by law, providing honest feedback directly to the other party, leaving a factual and fair review of services received, or exercising any rights protected under applicable consumer protection laws.
A breach of this clause may result in the termination of services, the pursuit of legal remedies for damages, and the forfeiture of any remaining service credits or unused hours.
Payment
All sessions must be paid in full at the time of booking and before the scheduled appointment. We accept payment via credit or debit card (Visa, Mastercard, American Express, Discover), Venmo, CashApp, and PayPal.
Project invoices are due upon receipt unless otherwise specified in writing. Late payments are subject to a 1.5% monthly interest charge on outstanding balances after 30 days.
Refund Policy
All sales are final. No refunds or exceptions will be made. This applies to consultations, brand roadmaps, project fees, subscription plans, digital products, coaching sessions, and all other services and products offered by Moto.Red.
Cancellation and Rescheduling
You may cancel or reschedule your session at least 48 hours before your scheduled appointment. If you fail to do so, you will be charged for the full session and will not have the opportunity to redeem it.
Moto.Red reserves the right to make exceptions for emergency circumstances when deemed appropriate at our sole discretion.
Digital Recording
All sessions will be recorded. A copy will be provided to you via Dropbox within 5 to 15 standard business days (up to 3 calendar weeks) of the session. We reserve the right not to provide a copy of the session based on the nature and content of the session at our sole discretion.
If a download link is provided, the Client has 30 days to download their copy. If the link expires before the Client can download their copy, a $25 fee is required for a new link to be provided.
File Delivery and Storage
Files are delivered within a timeline specified in the project agreement. The Client has seven days from delivery to confirm files are usable and to request any alterations or replacements based on the agreement.
Files are stored for up to 3 years unless circumstances beyond Moto.Red’s control occur, such as hardware failure. The Client may request one additional copy of their files within the first year at no charge in case of loss or misplacement. A $200 replacement fee will be billed for each additional request thereafter, as long as Moto.Red still possesses the files and can deliver a new copy.
Force Majeure
Neither party shall be held liable for any delay or failure in performance resulting from causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, power outages, internet disruptions, cyberattacks, civil unrest, or any other event that could not have been reasonably anticipated or prevented.
In the event of a force majeure occurrence, the affected party will notify the other party as soon as reasonably possible and both parties will work in good faith to adjust timelines and deliverables accordingly.
Legal Disputes and Limitation of Liability
In the event of a dispute, both parties agree to first attempt resolution through informal good faith negotiation for a period of 30 days. If informal resolution fails, the parties agree to participate in mediation in King or Snohomish County, Washington, before pursuing litigation.
Legal disputes that proceed beyond mediation will be handled through our attorneys. The Client will be responsible for all of Moto.Red’s reasonable legal fees to the extent permissible by law. The jurisdiction for any legal disputes will be the courts of Snohomish or King County, Washington State, USA.
Moto.Red’s total liability is limited to the amount paid by the Client for the services rendered under the specific engagement in question. In no event shall Moto.Red be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.
Any claim arising from services provided by Moto.Red must be filed within one (1) year of the event giving rise to the claim. Claims not filed within this period are permanently waived.
Indemnification
The Client agrees to indemnify, defend, and hold harmless Moto.Red Design House LLC, Ruby Rayne, and any agents, associates, contractors, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to: the Client’s breach of these Terms and Conditions; the Client’s use of services or deliverables provided by Moto.Red; any content, materials, or information provided by the Client for use in the project; or any third-party claim related to the Client’s business, products, or services.
Class Action Waiver
The Client agrees that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. The Client waives any right to participate in a class action lawsuit or class-wide arbitration against Moto.Red.
Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Entire Agreement
These Terms and Conditions, together with any project-specific agreements, proposals, or statements of work, constitute the entire agreement between the Client and Moto.Red Design House LLC. They supersede all prior communications, understandings, and agreements, whether written or oral, relating to the subject matter herein.
Modifications to Terms
Moto.Red reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the modified terms. Clients with active projects will be notified of material changes via email.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Washington, United States of America, without regard to its conflict of law principles.
Acceptance of Terms
By making any payment towards an invoice, booking a session, or engaging Moto.Red’s services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
COACHING WAIVER AND DISCLAIMER
Coaching Waiver and Disclaimer
Nature of Coaching Services
Moto.Red Design House LLC (“Moto.Red”) offers strategic coaching services designed to help entrepreneurs and business owners clarify their vision, refine their business models, develop service offerings, strengthen brand positioning, and build sustainable income strategies. These services are educational, strategic, and creative in nature.
Coaching sessions may involve discussions about personal goals, mindset, creative blocks, motivation, professional challenges, and other topics that touch on emotional and psychological well-being. The Client acknowledges that these conversations are conducted within the context of business strategy and creative development, not within a clinical, therapeutic, or medical framework.
Coaching Is Not Therapy, Counseling, or Medical Treatment
Ruby Rayne and Moto.Red are not licensed therapists, psychologists, psychiatrists, counselors, social workers, or medical professionals. Coaching services are not a substitute for professional mental health care, psychiatric treatment, psychological counseling, medical advice, legal counsel, or financial advisory services.
No coaching session, program, course, digital product, or communication from Moto.Red should be interpreted as a diagnosis, treatment plan, clinical assessment, or medical recommendation. Coaching does not create a therapist-client, doctor-patient, or any other licensed professional-client relationship.
If the Client is currently experiencing a mental health crisis, suicidal ideation, severe anxiety, depression, or any condition that requires clinical intervention, the Client is strongly encouraged to seek support from a licensed mental health professional. In the event of a medical or psychiatric emergency, the Client should contact 911 or the 988 Suicide and Crisis Lifeline immediately.
Neurodivergent-Affirming Approach
Moto.Red embraces a neurodivergent-affirming approach to coaching. We recognize that entrepreneurs think, process, and create differently, and our coaching methods are designed to meet Clients where they are. This approach may include discussions about how neurodivergent experiences intersect with business strategy, creative output, and professional development.
This affirming stance does not constitute a diagnosis, clinical assessment, or accommodation plan. The Client understands that any neurodivergent-related support provided within coaching is strategic and experiential in nature, not clinical. Clients seeking formal diagnosis, treatment, or clinical accommodations should consult a qualified healthcare provider.
No Guarantee of Results
Moto.Red makes no guarantees, representations, or warranties regarding the outcome of coaching services. Results depend on a wide range of factors including but not limited to the Client’s individual effort, follow-through, market conditions, timing, business circumstances, and decisions made before, during, and after the coaching engagement.
Any examples of past results, case studies, testimonials, or income figures shared by Moto.Red are provided for illustrative purposes only and do not constitute a promise that the Client will achieve similar outcomes. Past performance is not indicative of future results.
The Client accepts full responsibility for their own business decisions and actions taken based on information, strategies, or perspectives discussed during coaching. Moto.Red is not liable for any business losses, missed opportunities, failed ventures, or financial outcomes resulting from the Client’s application of coaching insights.
Client Responsibilities
The Client agrees to participate in coaching sessions honestly and in good faith. The Client is responsible for communicating their needs, boundaries, and any concerns that arise during the coaching relationship.
The Client is solely responsible for determining whether the strategies, insights, and recommendations discussed in coaching are appropriate for their specific business situation. The Client agrees to conduct their own due diligence, seek independent professional advice where appropriate (including legal, financial, tax, and medical professionals), and make their own informed decisions.
The Client agrees to disclose any relevant mental health conditions, physical limitations, or personal circumstances that may affect their ability to participate safely and productively in coaching. Moto.Red reserves the right to pause, modify, or discontinue coaching services if it becomes apparent that the Client would be better served by a licensed professional.
Scope of Practice
Moto.Red operates strictly within the scope of business strategy, creative development, brand positioning, service design, income strategy, and entrepreneurial coaching. Moto.Red does not provide and will not be held liable for: clinical mental health services, licensed financial planning or investment advice, legal counsel, medical diagnoses or treatment recommendations, or tax preparation and accounting services.
If a topic arises during coaching that falls outside this scope of practice, Moto.Red will advise the Client to consult the appropriate licensed professional. Any general information shared on topics adjacent to but outside this scope is provided as personal perspective only and should not be treated as professional advice in that discipline.
Emotional and Psychological Acknowledgment
The Client acknowledges that coaching can surface challenging emotions, including frustration, self-doubt, vulnerability, grief, and discomfort associated with personal and professional growth. These emotional responses are a normal part of the growth process but are not the focus of clinical treatment within the coaching relationship.
The Client understands that Moto.Red is not equipped to manage mental health crises and agrees to seek appropriate professional support if the emotional intensity of any topic exceeds what can be safely addressed in a coaching context. Moto.Red reserves the right to pause a session or recommend external support at any time.
Assumption of Risk
The Client voluntarily assumes all risks associated with participating in coaching services. This includes but is not limited to the risk of emotional discomfort, business decisions that do not produce the desired outcome, financial investment in strategies that may not yield a return, and any other foreseeable or unforeseeable consequences of applying coaching insights to the Client’s business and life.
The Client acknowledges that they have entered into the coaching relationship of their own free will, have not been coerced, and understand the nature and limitations of coaching as described in this document.
Limitation of Liability
To the fullest extent permitted by Washington State law and applicable federal law, Moto.Red Design House LLC, Ruby Rayne, and any associates, contractors, or agents shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to coaching services, including but not limited to lost profits, lost revenue, emotional distress, business failure, reputational harm, or any other damages whether foreseeable or unforeseeable.
In the event that any liability is established despite the limitations set forth herein, Moto.Red’s total aggregate liability shall not exceed the amount paid by the Client for the specific coaching session or package that gave rise to the claim.
Release and Waiver of Claims
By engaging Moto.Red’s coaching services, the Client hereby releases, waives, discharges, and agrees not to sue Moto.Red Design House LLC, Ruby Rayne, and any agents, associates, contractors, successors, and assigns from any and all claims, demands, actions, or causes of action arising out of or related to the coaching services provided, whether based in contract, tort, negligence, strict liability, or any other legal theory.
This release does not apply to claims arising from gross negligence or intentional misconduct by Moto.Red, as such waivers are unenforceable under Washington State law.
Right to Refuse or Discontinue Service
Moto.Red reserves the right to refuse, pause, or discontinue coaching services at any time if, in its sole professional judgment, the Client would be better served by a licensed therapist, counselor, or other professional; the Client is in crisis and requires immediate clinical intervention; the coaching relationship has become unproductive or adversarial; or the Client has violated these terms, the Terms and Conditions, or the Mutual Non-Disparagement agreement.
In such cases, Moto.Red will make reasonable efforts to communicate the decision respectfully and, where appropriate, provide referrals to qualified professionals. Any unused coaching hours or sessions will be handled in accordance with the Refund Policy outlined in the Terms and Conditions.
Digital Products, Courses, and Written Materials
All digital products, courses, workbooks, templates, guides, and written materials created or distributed by Moto.Red are provided for educational and strategic purposes only. These materials are based on the professional experience and perspective of the author and do not constitute licensed professional advice in any discipline.
The Client assumes all responsibility for how they apply the information contained in digital products and written materials. Moto.Red is not liable for any outcomes resulting from the use or misuse of these materials.
Governing Law
This Coaching Waiver and Disclaimer is governed by and construed in accordance with the laws of the State of Washington, United States of America. Any disputes arising under this waiver shall be subject to the dispute resolution procedures outlined in the Moto.Red Terms and Conditions.
Acceptance of This Waiver
By booking a coaching session, purchasing a coaching package, enrolling in a course, purchasing a digital product, or engaging Moto.Red’s coaching services in any capacity, the Client acknowledges that they have read, understood, and voluntarily agree to be bound by this Coaching Waiver and Disclaimer in its entirety.
RECORDING CONSENT AND WAIVER
Recording Consent and Waiver
Notice of Recording
Moto.Red Design House LLC (“Moto.Red”) records all coaching sessions, consultations, strategy calls, and collaborative working sessions conducted via Zoom or any other video conferencing, telephone, or digital communication platform. Both audio and video are recorded unless otherwise agreed to in writing prior to the session.
Washington State is a two-party consent state under RCW 9.73.030, which requires the consent of all parties before a private communication may be lawfully recorded. By engaging Moto.Red’s services and participating in any session, the Client provides their express consent to the recording of all sessions in compliance with this law.
Purpose of Recording
Recordings are made for the following purposes: to provide the Client with a reference copy of the session for their personal and business use; to allow Moto.Red to review session content for continuity, quality assurance, and preparation for future sessions; and to document the scope of services provided, strategies discussed, and agreements made during the session.
Recordings will not be used for marketing, promotional, or public-facing purposes without the Client’s separate written consent. If Moto.Red wishes to use any portion of a recording for testimonials, case studies, training materials, or other promotional purposes, a separate written release will be requested from the Client.
Client Copy and Delivery
A copy of the session recording will be provided to the Client via Dropbox or another secure file-sharing platform within 5 to 15 standard business days (up to 3 calendar weeks) of the session date.
Moto.Red reserves the right not to provide a copy of the session recording based on the nature and content of the session at our sole discretion. This may include but is not limited to sessions where sensitive third-party information was discussed, sessions where the content could be harmful if taken out of context, or sessions where technical issues affected the quality of the recording.
If a download link is provided, the Client has 30 days to download their copy. If the link expires before the Client downloads the recording, a $25 fee is required for a new link to be generated, subject to file availability.
Client Use of Recordings
Session recordings provided to the Client are for the Client’s personal and internal business use only. The Client may not distribute, publish, broadcast, upload, share on social media, or otherwise make the recording available to any third party without Moto.Red’s prior written consent.
The Client may not edit, alter, or manipulate the recording in any way that misrepresents the content, context, or tone of the session. The Client may not use recordings or excerpts thereof in legal proceedings against Moto.Red except as required by law or court order.
Client Recording of Sessions
The Client may not independently record any session (audio, video, screen capture, or any other method) without Moto.Red’s prior written consent. Unauthorized recording by the Client is a violation of Washington State law (RCW 9.73.030) and may result in immediate termination of services, forfeiture of unused session credits, and legal action.
If the Client wishes to make their own recording for personal reference, they must request permission in writing before the session begins. Moto.Red reserves the right to deny this request at its sole discretion.
Storage and Retention
Session recordings are stored securely by Moto.Red for up to 12 months from the date of the session unless otherwise required by law or agreed to in writing. After the retention period, recordings may be permanently deleted without notice.
Moto.Red is not responsible for the loss of recordings due to technical failure, hardware malfunction, software errors, cyberattacks, or any other circumstance beyond our reasonable control. While we take reasonable precautions to protect stored recordings, we do not guarantee the indefinite preservation of any recording.
Confidentiality of Recordings
Moto.Red treats all session recordings as confidential. Recordings will not be shared with any third party without the Client’s written consent, except as required by law, court order, or valid legal process.
In the event that a session recording contains confidential business information as defined in the Moto.Red Terms and Conditions, that information remains subject to the confidentiality protections outlined therein regardless of the recording medium.
Waiver of Claims Related to Recording
The Client waives any and all claims against Moto.Red Design House LLC, Ruby Rayne, and any agents, associates, contractors, successors, and assigns arising from or related to the recording of sessions, including but not limited to claims related to privacy, defamation, misrepresentation, emotional distress, or any other claim arising from the existence, content, storage, or delivery of session recordings.
This waiver does not apply to claims arising from Moto.Red’s intentional unauthorized distribution of recordings in violation of the confidentiality provisions outlined above.
Technical Issues and Recording Failures
Moto.Red is not liable for recording failures due to technical issues including but not limited to internet connectivity problems, platform outages, software malfunctions, or hardware failures. In the event of a recording failure, Moto.Red will notify the Client and make reasonable efforts to document key session takeaways in writing. No refund or credit will be issued for sessions that were not successfully recorded.
Governing Law
This Recording Consent and Waiver is governed by the laws of the State of Washington, United States of America, including but not limited to RCW 9.73.030 and related statutes. Any disputes arising under this waiver shall be subject to the dispute resolution procedures outlined in the Moto.Red Terms and Conditions.
Acceptance of This Waiver
By booking a session, joining a call, or participating in any recorded communication with Moto.Red, the Client acknowledges that they have read, understood, and voluntarily consent to the recording of all sessions and agree to be bound by this Recording Consent and Waiver in its entirety.
CLIENT SELF-SCHEDULING POLICY
Client Self-Scheduling Policy
Scheduling Platform
Moto.Red Design House LLC (“Moto.Red”) uses Acuity Scheduling (a Squarespace product) to manage all session bookings, consultations, and coaching appointments. By using the scheduling platform to book a session, the Client agrees to the terms outlined in this policy as well as the Moto.Red Terms and Conditions.
The Client acknowledges that Acuity Scheduling is a third-party platform and that Moto.Red is not responsible for any technical issues, outages, data handling practices, or service interruptions caused by the platform. The Client is encouraged to review Acuity Scheduling’s own terms of service and privacy policy.
Booking and Payment
All sessions must be paid in full at the time of booking and before the scheduled appointment. Payment is required to confirm the appointment. An unpaid booking is not a confirmed appointment and may be removed from the schedule without notice.
Session availability is displayed in real time and is subject to change. Booking a session is first-come, first-served. Moto.Red does not hold or reserve time slots without payment.
Client Responsibilities
The Client is responsible for selecting the correct session type, date, and time when booking. The Client is responsible for verifying that the time zone displayed in the scheduling platform matches their local time zone. Moto.Red is not responsible for missed sessions due to time zone errors on the Client’s end.
The Client is responsible for providing accurate contact information at the time of booking. If Moto.Red is unable to reach the Client due to incorrect contact information, the session may be forfeited without refund or credit.
The Client is responsible for joining the session on time using the link or instructions provided in the booking confirmation. If the Client is more than 15 minutes late to a session without prior communication, the session may be marked as a no-show and forfeited.
Cancellation and Rescheduling
The Client may cancel or reschedule a session at least 48 hours before the scheduled appointment time. Cancellations and reschedules can be made through the link provided in the booking confirmation email.
If the Client fails to cancel or reschedule within the 48-hour window, the full session fee is forfeited and no refund, credit, or replacement session will be issued.
Moto.Red reserves the right to make exceptions for genuine emergency circumstances at our sole discretion. Emergency exceptions are not guaranteed and should not be expected.
No-Show Policy
If the Client does not attend a scheduled session and has not canceled or rescheduled within the required timeframe, the session is considered a no-show. No-show sessions are non-refundable and non-transferable.
Repeated no-shows (two or more within a 90-day period) may result in the requirement of a prepaid session package before future bookings are permitted, or the suspension or termination of the Client’s ability to book sessions.
Cancellations by Moto.Red
Moto.Red reserves the right to cancel or reschedule a session due to illness, emergency, technical failure, or other circumstances beyond our reasonable control. In such cases, the Client will be notified as soon as possible and offered a rescheduled session at a mutually agreeable time. If a suitable reschedule cannot be arranged, a credit will be applied to the Client’s account for future use.
Moto.Red will not be liable for any indirect damages, lost opportunities, or inconvenience resulting from a session cancellation initiated by Moto.Red.
Session Format and Platform
Unless otherwise specified, all sessions are conducted via Zoom or another video conferencing platform designated by Moto.Red. The Client is responsible for ensuring they have a stable internet connection, a working camera and microphone (if video is required), and access to the designated platform prior to the session.
Moto.Red is not responsible for technical issues on the Client’s end that prevent participation in a session. If a session cannot proceed due to the Client’s technical difficulties, the session will not be refunded or rescheduled unless Moto.Red agrees to do so at its sole discretion.
Intake Forms and Pre-Session Information
Certain session types may require the Client to complete an intake form or provide information prior to the appointment. Failure to complete required pre-session materials may result in a less productive session. Moto.Red is not responsible for suboptimal outcomes when the Client has not completed the required preparation.
Information provided through intake forms is subject to the Moto.Red Privacy Policy and will be treated as confidential in accordance with the Terms and Conditions.
Data and Privacy
Information collected through the scheduling platform (including name, email address, phone number, and any intake form responses) is used solely for the purpose of delivering and managing Moto.Red’s services. This information is subject to the Moto.Red Privacy Policy.
The Client acknowledges that their data is also subject to Acuity Scheduling’s privacy practices, which are governed by Squarespace’s privacy policy. Moto.Red encourages the Client to review those terms independently.
Governing Law
This Client Self-Scheduling Policy is governed by the laws of the State of Washington, United States of America. Any disputes arising under this policy shall be subject to the dispute resolution procedures outlined in the Moto.Red Terms and Conditions.
Acceptance of This Policy
By using the Moto.Red scheduling platform to book any session, consultation, or appointment, the Client acknowledges that they have read, understood, and agree to be bound by this Client Self-Scheduling Policy in its entirety.

Information Collected Automatically: Our website uses Plausible Analytics, a privacy-focused, cookieless analytics platform. Plausible does not use cookies, does not collect personal data, does not track individual visitors across sessions, and is fully compliant with GDPR, CCPA, and PECR without requiring a cookie consent banner. The aggregate data collected by Plausible includes page views, referral sources, browser type, device type, and general geographic region (country level). No individual visitor profiles are created.
Anti-Spam Data: Our website uses CleanTalk, a cloud-based anti-spam service, to protect our forms from automated spam submissions. CleanTalk may process your IP address, email address, and form submission data for the sole purpose of spam detection. CleanTalk does not use this data for advertising or marketing purposes.
Session and Communication Data: When you participate in coaching sessions, consultations, or collaborative working sessions, we may collect session recordings (audio and video) via Zoom, AI-generated session transcripts and summaries via Fathom AI and Zoom AI, chat messages and files shared during sessions, and email and other written communications between you and Moto.Red.
How We Use Your Information
We use the information we collect to deliver and improve our design, coaching, and consulting services; to process payments and manage your account; to communicate with you about your projects, sessions, and purchases; to provide session recordings and deliverables; to maintain internal business records and documentation; to protect our legal rights and comply with applicable law; to improve our website and services based on aggregate analytics; and to prevent spam, fraud, and abuse.
We do not use your personal information for targeted advertising. We do not sell your personal information to any third party. We do not create individual user profiles for marketing purposes.

Website Hosting: Our website is hosted on WordPress with the Divi theme by Elegant Themes. Standard server logs may be maintained by our hosting provider.
Website Analytics: Plausible Analytics (Plausible Insights OÜ) is used for privacy-friendly, cookieless website analytics. No personal data is collected or stored by Plausible.
Anti-Spam: CleanTalk (CleanTalk Inc.) is used for spam protection on website forms.

You may request earlier deletion of your personal data by contacting us, subject to our legal obligations to retain certain records.

All sales are final. No refunds will be issued for any reason. This includes but is not limited to dissatisfaction with deliverables or guidance received, change of mind after purchase, expectations not met regardless of the basis for those expectations, and any other reason whatsoever. By clicking on any advertisement and subsequently booking services or purchasing products, you acknowledge and accept this no-refund policy. This no-refund policy is a material term of the transaction and your agreement to it is a condition of purchase.

You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to your engagement with Moto.Red advertising, your violation of these Advertising Terms, or any third-party claims resulting from your use of information obtained through Moto.Red advertisements.
Geographic Reach and Legal Compliance
Advertisements may be shown to audiences in any geographic location reached by the advertising platforms used. By booking services after viewing an advertisement, you represent and warrant that you are located in a jurisdiction where the services you are purchasing are legally permitted and that you are not prohibited by any applicable local, state, national, or international law from receiving such services.
Modification of Advertising Terms
Moto.Red reserves the right to modify advertising content, pricing, service descriptions, and these Advertising Terms at any time without prior notice. Your booking of any service constitutes acceptance of these Advertising Terms as they exist at the time of purchase, regardless of when you viewed the original advertisement. The current version of these terms is always available on this page.
Dispute Resolution and Governing Law
ARBITRATION AGREEMENT: Any dispute, controversy, or claim arising out of or relating to these Advertising Terms, any Moto.Red advertisement, or any services purchased following engagement with an advertisement, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Arbitration shall take place in King County, Washington. Each party shall bear its own costs, expenses, and attorney fees unless the arbitrator determines otherwise. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Moto.Red or any Released Party.
GOVERNING LAW: These Advertising Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. To the extent that any legal proceeding is not subject to arbitration, exclusive jurisdiction and venue shall lie in the state and federal courts located in King County, Washington.
Severability
If any provision of these Advertising Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Entire Agreement
These Advertising Terms, together with all other agreements, waivers, and terms published on this page and the service-specific agreements applicable to the services you purchase, constitute the entire agreement between you and Moto.Red regarding the subject matter herein. No oral or written statement by any Moto.Red representative, including in advertising materials, shall modify or supplement these terms unless set forth in a signed written amendment.

Client Deliverables and Project Work
Intellectual property rights for client deliverables are governed by the Confidentiality and Intellectual Property Rights section of the Moto.Red Terms and Conditions. Upon full payment, the Client owns the intellectual property rights to the final deliverables created specifically for them, while Moto.Red retains rights to all pre-existing materials, methodologies, tools, frameworks, templates, and processes used in the creation of those deliverables. User-Submitted Content
Any content, feedback, ideas, suggestions, or materials you submit to Moto.Red through our website, email, social media, or any other channel become the property of Moto.Red upon submission, unless otherwise agreed to in writing. Overview
Moto.Red Design House LLC (“Moto.Red”) may offer an affiliate or referral program that allows approved participants (“Affiliates”) to earn commissions by referring new clients to Moto.Red services and products. These Affiliate Program Terms govern participation in any such program.
By applying to or participating in the Moto.Red affiliate program, you agree to be bound by these terms in addition to all other terms published on this page.
Eligibility and Approval
Participation in the affiliate program is by application and approval only. Moto.Red reserves the right to accept or reject any application at its sole discretion and without providing a reason. Moto.Red may terminate any affiliate relationship at any time with or without cause.
Affiliates must be at least 18 years of age and must operate in compliance with all applicable local, state, federal, and international laws. Affiliates may not participate if they are located in a jurisdiction where affiliate marketing is prohibited or restricted by law.
Commission Structure
Commission rates, payment thresholds, payment methods, and payment schedules will be specified in the affiliate agreement provided upon approval. Moto.Red reserves the right to modify commission rates and payment terms at any time with 30 days written notice to active Affiliates.
Commissions are earned only on qualifying purchases made by new clients referred through the Affiliate’s unique referral link or code. Commissions are not earned on self-referrals, fraudulent referrals, referrals from individuals who were already Moto.Red clients, or transactions that are subsequently refunded, disputed, or charged back.
Promotional Guidelines
Affiliates may promote Moto.Red services using their unique referral link or code through their own website, blog, social media, email list, podcast, or other owned media channels. All promotional content must be truthful, accurate, and not misleading.
Affiliates must not make false or exaggerated claims about Moto.Red services, outcomes, or earnings potential; create fake reviews, testimonials, or endorsements; use spam, unsolicited email, or any deceptive marketing practices; bid on Moto.Red brand keywords (such as “Moto.Red” or “Ruby Rayne”) in paid search advertising without prior written permission; use Moto.Red trademarks, logos, or brand assets in any way that implies official endorsement or employment without prior written permission; or engage in any promotional activity that could damage Moto.Red’s reputation or brand.
FTC Disclosure Requirements
In accordance with the Federal Trade Commission Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255), Affiliates are required to clearly and conspicuously disclose their affiliate relationship with Moto.Red in all promotional content. Disclosures must be placed near or within the promotional content itself and must not be hidden in footnotes, separate pages, or behind links. Acceptable disclosure language includes: “This is an affiliate link. I may earn a commission if you make a purchase” or similar clear and conspicuous statements.
Failure to comply with FTC disclosure requirements may result in immediate termination from the affiliate program and forfeiture of unpaid commissions.
Intellectual Property
Affiliates are granted a limited, non-exclusive, non-transferable, revocable license to use Moto.Red-provided marketing materials, logos, and brand assets solely for the purpose of promoting Moto.Red services under the affiliate program. This license terminates immediately upon termination of the affiliate relationship. Affiliates may not modify Moto.Red brand assets without prior written approval.
Liability and Indemnification
Moto.Red is not liable for any losses, damages, or expenses incurred by Affiliates in connection with their promotional activities. Affiliates participate in the program at their own risk and expense.
Affiliates agree to indemnify, defend, and hold harmless Moto.Red Design House LLC, Ruby Rayne, and all respective officers, members, agents, contractors, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to the Affiliate’s promotional activities, violation of these terms, or any third-party claims related to the Affiliate’s marketing practices.
Termination
Either party may terminate the affiliate relationship at any time with written notice. Upon termination, the Affiliate must immediately cease all promotional activities for Moto.Red, remove all Moto.Red affiliate links and marketing materials from their channels, and return or destroy any confidential information provided by Moto.Red. Commissions earned prior to termination will be paid according to the standard payment schedule, provided the minimum payment threshold has been met and the commissions are not subject to reversal due to fraud or chargebacks.
Governing Law
These Affiliate Program Terms are governed by the laws of the State of Washington, United States of America. Any disputes arising under these terms shall be subject to the dispute resolution procedures outlined in the Moto.Red Terms and Conditions.
AI Tools and Technology Disclosure
AI Tools and Technology Disclosure
Commitment to Transparency
Moto.Red Design House LLC (“Moto.Red”) is committed to transparency about the tools and technologies we use in our business operations. As artificial intelligence becomes an integral part of modern creative and business workflows, we believe our clients and website visitors deserve clear information about how AI tools are used in our practice.
This disclosure is published proactively and in anticipation of Washington State HB 2225 (passed March 2026, effective January 2027), which requires businesses to disclose certain uses of AI in consumer-facing contexts. Moto.Red intends to meet or exceed these disclosure requirements.
AI Tools Currently in Use
Fathom AI (Fathom Video, Inc.): Moto.Red uses Fathom AI during coaching sessions, consultations, and collaborative working sessions conducted via Zoom. Fathom records sessions, generates real-time transcripts, and produces AI-generated summaries of session content. These transcripts and summaries are used for session documentation, continuity between sessions, and quality assurance. Fathom AI processes audio and video data from sessions to generate these outputs. The Client is informed of and consents to the use of Fathom AI through the Recording Consent and Waiver.
Zoom AI (Zoom Video Communications, Inc.): Moto.Red uses Zoom’s built-in AI features, which may include AI-powered meeting summaries, smart recording highlights, and other AI-assisted meeting tools provided by the Zoom platform. These features process session audio and video to generate summaries, action items, and other meeting intelligence. The Client is informed of and consents to Zoom’s AI features through the Recording Consent and Waiver.
AI-Assisted Creative and Business Tools: Moto.Red may use AI-assisted tools in the course of its creative and business operations, including but not limited to AI writing assistants for drafting, editing, and brainstorming content; AI image generation tools for concept exploration and visual ideation; AI-powered research and analysis tools; AI-assisted coding and web development tools; and AI-powered business operations tools such as scheduling optimization, email management, and project management.
How AI Is Used in Client Work
AI as a Tool, Not a Replacement: AI tools are used to augment and support Moto.Red’s professional expertise, not to replace it. All client-facing deliverables, strategies, and recommendations are developed, reviewed, refined, and approved by Ruby Rayne and the Moto.Red team. AI-generated output is treated as a starting point or reference, never as a final product delivered without human oversight and professional judgment.
Session Recording and Documentation: Fathom AI and Zoom AI are used to record and transcribe coaching sessions and consultations. These recordings and transcripts are used to maintain accurate session records, prepare for follow-up sessions, and provide the Client with reference materials. The AI-generated transcripts and summaries may contain errors or inaccuracies. Moto.Red does not guarantee the accuracy of AI-generated transcripts or summaries.
Creative Development: AI tools may be used during the creative development process for tasks such as initial concept generation, mood board and visual reference exploration, copy drafting and editing, research and competitive analysis, and prototyping and wireframing. The final creative output delivered to clients is always the product of Moto.Red’s professional creative process, informed by but not solely generated by AI tools.
Business Operations: AI tools may be used in Moto.Red’s internal business operations for tasks such as email management, scheduling, invoicing, bookkeeping support, content planning, and administrative tasks. These operational uses do not directly affect client deliverables.
Data and Privacy Considerations
When AI tools process client data (such as session recordings, project details, or business information), that data is subject to the privacy policies of both Moto.Red and the respective AI tool provider. Key privacy considerations include:
Fathom AI’s data processing practices are governed by Fathom Video, Inc.’s privacy policy. Zoom AI’s data processing practices are governed by Zoom Video Communications, Inc.’s privacy policy. Moto.Red selects AI tools that demonstrate a commitment to data privacy and security, but cannot guarantee the data handling practices of third-party AI providers. Client data shared with AI tools is limited to what is necessary for the intended purpose. Confidential business information shared during client engagements is subject to the confidentiality protections outlined in the Moto.Red Terms and Conditions regardless of whether AI tools are used in the processing of that information.

Client Rights Regarding AI Use
Clients have the right to ask questions about how AI tools are used in their specific engagement; to request that specific AI tools not be used during their sessions (such as requesting that Fathom AI not be activated), subject to any impact this may have on session documentation and deliverables; to request information about which AI tools were used in the creation of their deliverables; and to request deletion of AI-generated transcripts and summaries related to their sessions, subject to the limitations described in the Recording Consent and Waiver and the Consumer Health Data Privacy Policy.
Requests to limit or exclude AI tool usage should be communicated in writing before the session or project begins. Moto.Red will make reasonable efforts to accommodate such requests. Some requests may affect the scope, timeline, or documentation of services provided.
Accuracy and Limitations of AI
AI tools are powerful but imperfect. Moto.Red acknowledges that AI-generated content may contain errors, inaccuracies, biases, or hallucinated information; AI transcripts may not perfectly capture spoken words, tone, or context; AI summaries may omit important details or mischaracterize discussions; and AI-generated creative content requires human review and refinement before use.
Moto.Red does not represent any AI-generated output as infallible or as a substitute for professional judgment. All AI-assisted work is reviewed and refined through Moto.Red’s professional creative and strategic process.
Changes to AI Tool Usage
The AI tools and technologies used by Moto.Red may change over time as new tools become available and existing tools evolve. This disclosure will be updated to reflect material changes in AI tool usage. Clients with active engagements will be notified of significant changes that directly affect how their data is processed or how their deliverables are created.

Moto.Red reserves the right to immediately terminate services, forfeit unused session credits, and decline future engagements with any client who engages in discriminatory or abusive conduct. This is in addition to any other remedies available under the Terms and Conditions, including the Mutual Non-Disparagement clause.
